Bulgaria’s President refers to Constitutional Court over temporary commission for draft Constitution

Bulgaria’s President Rumen Radev on October 13 referred to the Constitutional Court with a request to declare the decision by which a Temporary Commission for Consideration of a Draft Constitution of the Republic of Bulgaria was established, as being unconstitutional.

The request states that one of the tasks of the temporary commission, namely to propose new changes to the Constitution, contradicts the basic law.

The President clarified that changes in an already submitted draft of a new constitution can be made only by the Grand National Assembly. He added that the current National Assembly can only discuss whether the Grand National Assembly should be convened on the draft or not.

According to the head of state, exceeding the constitutional competence of the National Assembly violates the principle of the rule of law and is an example of resolving political crises by abusing a constitutional initiative.
