CC: The newly elected constitutional judges will not get a full term in office
If elected as Constitutional Judges, Desislava Atanasova and Borislav Belazelkov will finish their current term and will not get a full 9-year term in office.
Desislava Atanasova is the nomination of GERB for Constitutional Judge.
Borislav Belazelkov is the candidate of “We Continue the change – Democratic Bulgaria”. This becomes clear from the decision of the Constitutional Court of January 11 in constitutional case No. 17/2023, initiated at the request of the President of the Republic of Bulgaria to give a binding interpretation of Art. 147, para. 2, Art. 148, para. 1(1) and Art. (3) of the Constitution of the Republic of Bulgaria on the following question:
"What is the duration of the term of office, its beginning and end, when a constitutional judge is elected (appointed) and takes office after the renewal of the Court provided for in Article 147, paragraph 2 of the Constitution?"
The Constitutional Court held:
"A constitutional judge elected or appointed after the constitutional renewal provided for in Article 147(2)(3) of the Constitution shall exercise his/her powers only for the remainder of the term of office from the constitutionally due time for the renewal of the Court."
All 10 constitutional judges were present at the meeting. The decision was passed unanimously.
